Terms of Service

1. Acceptance of Terms

By accessing or using the WhatsApp Marketing platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users, including visitors, registered users, and paying subscribers.

2. Description of Service

WhatsApp Marketing is a SaaS platform that enables businesses to send marketing campaigns, manage contacts, build chatbots, and automate messaging through the official WhatsApp Cloud API. We provide tools for contact management, campaign creation, analytics, and team collaboration.

3. Account Registration

  • You must provide accurate and complete registration information
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 18 years old to create an account
  • One person or legal entity may not maintain more than one free account
  • You are responsible for all activity that occurs under your account

4. Acceptable Use

You agree not to use the Service to:

  • Send spam, unsolicited messages, or messages to recipients who have not opted in
  • Violate WhatsApp Business Policy or Meta Platform Terms
  • Transmit malware, phishing attempts, or deceptive content
  • Harass, abuse, threaten, or incite violence against any individual or group
  • Violate any applicable laws, regulations, or third-party rights
  • Impersonate any person or entity or misrepresent your affiliation
  • Attempt to gain unauthorized access to the Service or its related systems
  • Use the Service for any illegal or unauthorized purpose

5. WhatsApp Compliance

As a user of our platform, you are responsible for complying with all WhatsApp Business policies, including but not limited to:

  • Obtaining proper consent from message recipients
  • Using approved message templates for business-initiated conversations
  • Respecting opt-out requests and maintaining suppression lists
  • Not sending messages that violate WhatsApp Commerce Policy

Violation of WhatsApp policies may result in suspension of your WhatsApp Business account by Meta, for which we bear no responsibility.

6. Subscription and Payments

  • Free plans are subject to usage limits as described on our pricing page
  • Paid subscriptions are billed monthly or annually in advance
  • All fees are non-refundable except as required by law
  • We reserve the right to change pricing with 30 days notice
  • Failure to pay may result in suspension or termination of your account
  • You are responsible for all applicable taxes

7. Intellectual Property

The Service and its original content, features, and functionality are owned by WhatsApp Marketing and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of all content you upload or create through the Service.

By using the Service, you grant us a limited license to process and transmit your content as necessary to provide the Service.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You are responsible for ensuring that your collection and use of contact data complies with applicable data protection laws (including GDPR, CCPA, and POPIA where applicable).

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from service interruptions.

10. Limitation of Liability

To the maximum extent permitted by law, WhatsApp Marketing shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms. You may terminate your account at any time through your account settings. Upon termination, your right to use the Service ceases immediately.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Nairobi, Kenya.
